Welcome to FEELS Consulting at feelsconsulting.com. These Terms of Service apply to your use of our website and purchases of our services and downloadable digital products. Please read them carefully before using the website or making a purchase.

1. Acceptance of Terms

By accessing or using our website, you agree to these Terms of Service, our Privacy Policy and other applicable policies or guidelines posted on our website. If you do not agree, please do not use the website. Any separate written service agreement governs the services covered by that agreement if it conflicts with these general website Terms. Nothing in these Terms excludes rights that cannot lawfully be excluded.

2. Use of Website

You may use the website to learn about, purchase and use FEELS Consulting services and resources for your personal needs or your own business's internal purposes, subject to any applicable product licence or service agreement. You may not use the website for an illegal or unauthorized purpose, infringe others' rights, misuse another person's information, or use automated means to interfere with the website's operation or security.

3. Purchases and Services

Purchases are subject to the applicable product or service description, any agreed written scope and our posted Return and Refund Policy, together with mandatory rights under applicable law. We may modify or discontinue an offering, limit quantities, decline or cancel an order, or refuse service, subject to applicable law and obligations for an accepted order. These Terms do not create additional refund, cancellation, delivery or service-performance guarantees.

The scope, scheduling, deliverables and fees for a consulting engagement are those disclosed for that service or agreed in writing. General website information, free scorecards and educational tools do not by themselves create an ongoing consulting engagement.

4. Pricing and Payment

Prices displayed on our website are in US dollars unless expressly stated otherwise. Prices may change for future purchases. Payment must be made using a valid payment method offered through our Shopify checkout or another payment arrangement expressly agreed for the relevant service. Shopify and applicable payment providers process checkout payments using their security controls. We do not promise that any system is completely secure.

5. Digital Products, Access and Delivery

Downloadable digital products are delivered electronically using the access instructions or download links provided for the order. Any file formats, included materials, system requirements and access terms stated in the product description apply. Digital-only products do not require physical shipment. Contact us if an expected access link or file is missing or does not work.

Unless an offering or separate agreement expressly grants broader rights, you may use purchased or free resources for your own personal or internal business purposes. You may not resell, redistribute, publicly share or sublicense the files or access links without our written permission. Commercial use of templates or other resources for multiple clients also requires separate written authorization from FEELS Consulting unless the applicable product license expressly permits that use. This provision does not remove rights granted by a separate licence or applicable law.

If an offering expressly includes physical goods, its stated shipping and delivery terms apply. Any delivery estimate is subject to applicable law and the terms disclosed for that order; these Terms do not add a shipping guarantee or waive non-excludable consumer rights.

6. Financial Health Scorecards and Educational Resources

Scorecards calculate educational results and recommendations from the information you provide. Their accuracy depends on your answers and assumptions; a score is not a financial diagnosis or a guarantee of a particular outcome. General educational materials and calculators are not a substitute for advice tailored to your circumstances under a separate professional engagement.

You may choose Unlock results only or Unlock results + subscribe. Marketing is optional and is not required for the same results or free workbook. New marketing enrollment through the scorecards is currently limited to eligible United States internet connections, as explained in the Privacy Policy. No country-of-residence declaration is required. A results request does not automatically resubscribe someone who previously unsubscribed. The Privacy Policy explains assessment-lead records, processing and your choices. Choosing an email option does not give consent to SMS marketing.

7. Intellectual Property

Website content, including text, graphics, logos, images, workbooks and software, belongs to FEELS Consulting or its licensors and is protected by applicable intellectual-property laws. Except for the use permitted by these Terms, an offering's licence, a separate agreement or applicable law, you may not use or reproduce that content without our written permission.

8. Disclaimer of Warranties

To the extent permitted by applicable law and except as expressly agreed in writing, the website, general resources and products are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the website or products will be error-free or meet every particular requirement. This clause does not exclude a warranty, service obligation or consumer right that cannot lawfully be excluded.

9. Limitation of Liability

To the extent permitted by applicable law, FEELS Consulting, its affiliates and licensors will not be liable for direct, indirect, incidental, special or consequential damages arising from use of the website or products. This limitation is subject to any applicable separate service agreement and does not exclude liability or remedies that cannot lawfully be excluded or limited.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold FEELS Consulting, its affiliates and licensors harmless from claims, damages or expenses arising from your unlawful use of the website or products, infringement of another person's rights, or breach of these Terms. This does not require indemnification for matters for which such a requirement would be prohibited by law.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles, except where mandatory applicable law provides otherwise. Nothing in these Terms limits consumer rights or protections that cannot lawfully be excluded.

12. Changes to Terms of Service

We may update these Terms from time to time. The revised Terms will be posted on this website with an updated effective date and any notice required by applicable law. Your continued use after the revised Terms take effect constitutes acceptance to the extent permitted by law. Changes do not retroactively remove rights under an existing purchase or written service agreement.
